This does not mean that you cannot pursue a personal injury claim for damages. In Massachusetts, you can still recover damages for injury or death if your negligence is not greater than the total amount attributable to the person or persons against whom recovery is sought. This is called Comparative Negligence. (M.G.L. c. 231, 85)
